These Terms of Service (hereinafter the « Terms ») govern all contractual relations between Innovation Data, a single-shareholder simplified joint-stock company with capital of €1,000, SIREN 100895051, RCS Dunkerque, operating the VOKAL trademark (hereinafter « Vokal »), and any individual or entity subscribing to a Vokal services plan (hereinafter the « Customer »).
1. Purpose
These Terms define the conditions under which Vokal provides the Customer with its services for voice recording of sales meetings, automatic generation of PDF quotes and invoicing via artificial intelligence.
The services are accessible via a web and mobile application.
2. Acceptance of Terms
Subscribing to a Vokal plan implies the Customer's full and unconditional acceptance of these Terms. Vokal reserves the right to modify the Terms at any time, by notifying the Customer by email at least 30 days before the changes take effect.
In case of disagreement, the Customer may terminate their subscription under the conditions set out in article 7.
3. Description of services
Vokal offers three main subscription plans:
• Vokal Solo: €29/month ex. VAT — to get started solo (1 user). • Vokal Pro: €59/month ex. VAT — the most popular, with premium CRM and AI follow-ups included. • Vokal Business: €99/month ex. VAT — for teams (up to 10 users), includes the Unpaid and Analytics modules.
Optional modules (SMS, Unpaid, Analytics) can be added à la carte to Solo and Pro plans.
The specific features of each plan are described on the Pricing page of the website and may evolve over time.
4. Pricing and billing
Prices are listed in euros excluding VAT (ex. VAT) on the vokal.fr website. The applicable French VAT rate (20% at the time of writing) will be added at billing.
Payment is monthly or annual, by credit card or SEPA direct debit. A 10% discount applies for annual billing.
An electronic invoice in Factur-X EN16931 format is issued at each billing cycle and sent to the Customer by email.
5. 30-day money-back guarantee
The Customer benefits from a 30-day money-back guarantee starting from subscription. During this period, if the Customer is not satisfied with the service, they may request a full refund of their first monthly fee.
To exercise this guarantee, the Customer must email contact@vokal.fr stating their account number.
6. Duration and renewal
The subscription is concluded with no fixed term, for a minimum duration of one month. It is tacitly renewed at each billing cycle (monthly or annual), unless terminated by either party under the conditions set out in article 7.
7. Termination
The Customer may terminate their subscription at any time, from their account dashboard or by email to contact@vokal.fr. Termination takes effect at the end of a one-month notice period from the notification.
Vokal reserves the right to terminate the subscription with immediate effect in case of serious breach of contractual obligations by the Customer, particularly in case of payment default, fraudulent use of the service, or violation of third-party rights.
8. Personal data and confidentiality
The processing of the Customer's personal data is governed by our Privacy Policy, accessible from the website footer.
Audio recordings and generated quotes are encrypted end-to-end and hosted in France, on EU servers compliant with GDPR.
9. Limitation of liability
Vokal undertakes to provide the service with diligence but cannot guarantee 100% availability. In case of prolonged unavailability of the service (more than 24 consecutive hours), the Customer may request a pro-rata credit.
Vokal's liability shall not exceed, in any case, the amount paid by the Customer over the three months preceding the event giving rise to the damage.
10. Applicable law and mediation
These Terms are subject to French law. Any dispute relating to their interpretation or execution shall be submitted to the exclusive jurisdiction of the courts in the Dunkerque district, subject to mandatory provisions applicable to consumers.
In accordance with article L. 612-1 of the French Consumer Code, the Customer may use the free mediation service MEDICYS, whose contact details are: medicys.fr.
